Terms and Conditions of purchase

These Terms and Conditions have been prepared based on the provisions of law in force in the Republic of Poland and define the rules of the Shop, including rules for the sale of Products.

Prerequisite for the conclusion of the Product Sales Agreement or Agreement is that the Customer read and understand the Terms and Conditions. The Terms and Conditions are available at the Shop’s website.

shop.playprint.pl possesses all the necessary rights to present Products in its Shop. The Products are supplied exclusively within the territory of the Republic of Poland.

 

DEFINITIONS

  • The Shop – operated by SCRATCH MAP WOJCIECH KOCZOROWSKI online shop operating at the address: http://www.shop.playprint.pl, and selling goods via the Internet;
  • Working days – all the days of the week from Monday to Friday, excluding public holidays;
  • Order completion time – the time in which the Shop completes an order and hands it over to the carrier executing the delivery method chosen by the Customer;
  • Customer – a natural person, a legal person or an organisational unit without legal personality making purchases in the Shop and possessing a customer account; 
  • Consultant – a person serving the Customer in the Customer Service Office (CSO);
  • Customer Account – a database containing customer data used to complete orders, an order history and other individual customer settings;
  • Traditional transfer – a bank payment made by the Customer using an internet or branch account or at the post office;
  • Electronic transfer – payment made by the Customer from an account with an online bank, using online payment systems; 
  • Agreement – the agreement to provide services electronically entered into voluntarily by the Customer and shop.playprint.pl at the moment of confirming Registration, which leads to the creation of an Account
  • Sales Agreement – an agreement to sell Products indicated in the Shop, entered into between shop.playprint.pl and the Customer according to the provisions of the Terms and Conditions.

 

ELECTRONIC PROVISION OF SERVICES

The services provided electronically by shop.playprint.pl include in particular, access to the trading platform, within which a Product Sales Agreement can be entered into.

Shop.playprint.pl manages a Customer Account and access to server space in order for Customers to place there data which shall be used to identify them and to contain Agreements and Sales Agreements.

In order to be able to use the Shop, the Customer must have access to a device which meets the technical requirements for functioning with shop.playprint.pl’s information technology system. The device must therefore, in particular, allow access to the Internet and possess web browser software which supports ‘cookies’, and an email account.

Depending on the Customer’s internet browser settings, shop.playprint.pl may place ‘cookie’ files on the Customer’s IT system. ‘Cookies’ make it possible to identify the Customer at a later time and are used by shop.playprint.pl to facilitate use of the Shop, and to track the Customer’s movements in the Shop. The Customer may at any time switch on or off shop.playprint.pl’s ability to use ‘cookies’ by changing the appropriate settings in the Customer’s internet browser.

In using the services provided by shop.playprint.pl, the Customer is prohibited from providing shop.playprint.pl content of an illegal nature.

 

USE OF THE SHOP

Products are available for purchase to:

a) registered Customers, i.e. entities possessing an Account with the Shop. Creation and use of an Account with the Shop is voluntary and free of charge.

In order to begin the process of Registration, the Customer shall provide the following information: login, password, email address, full name, address, telephone number, and, for Customers who run a business, company or name and tax ID number.

Next, the Customer shall accept the Terms and Conditions by checking the field “I accept the Terms and Conditions”.

Accepting the Terms and Conditions constitutes a declaration of the following:

  • I have read and understood, and accept, the Terms and Conditions,
  • I have started using the services of the Shop voluntarily,
  • the personal data presented at Registration were given voluntarily, and are correct and in accordance with the law.

On completing the above, the Customer shall receive an email message at the provided address requesting confirmation of the Registration by clicking on an activation link. Confirmation of Registration activates the Customer Account. At this moment the Agreement between the Customer and shop.playprint.pl is entered into for an indefinite period, and pertains to access to the services provided by shop.playprint.pl and the managing of a Customer Account.

Shop.playprint.pl creates an Account for the Customer, which is assigned to the login and password provided during Registration. The Customer gains access to the Account upon entering the assigned login and password in the relevant fields of the website (‘Log in’).

The Customer can change the data indicated in the point above which were provided during Registration. To do this, after logging in, the Customer should select the ‘Your profile’ option, where, in the ‘Edit data’ tab, they can be modified. The Customer also has access to the order history.

b) Customers without a login, after clicking on “Place an order”, where they shall provide the following information: full name, telephone number, email address, address and, for Customers who run a business, company or name and tax ID number.

Then, the Customer ‘Confirms the order’ by accepting the notification the Customer shall receive by email.

After this confirmation, the Customer completes payment for the Product by their chosen method.

 

CONCLUSION OF SALES AGREEMENT

Product orders can be placed in the Shop.

Orders can be placed in the shop at all hours, and on any day of the week.

Sales Agreements in the Shop shall be concluded in the following way:

  • The Customer selects a particular Product and adds the Product to their Basket. After adding the Product to the Basket, the Customer can continue shopping, update the Basket or proceed to concluding the Sales Agreement;
  • The Customer completes Registration or, if already in possession of an Account, logs in, confirms the contents of the Basket and in order to conclude the Sales Agreement clicks on “Complete order”;
  • The Customer then selects a method of payment and a method of delivery by choosing one of the available options.
  • After completing the above steps, the Customer confirms the order by clicking on “go to payment”. If selecting payment via PayU, the Customer will be redirected to that external website in order to pay for the chosen product.
  • Shop.playprint.pl sends a confirmation of the order to the email address provided by the Customer at Registration. The confirmation lists the details of the order (identifying the Product, its price, delivery costs, total payable amount, and delivery and payment methods). It the Customer selected “payment in advance” on the shop.playprint.pl bank account, the email shall also contain the shop.playprint.pl bank account details;
  • The Customer confirms the order by clicking on the activation link inside the email from shop.playprint.pl mentioned in the point above. At this moment the Sales Agreement is entered into between the Customer and shop.playprint.pl. The order can also be confirmed in the “order history” tab.

 

Shop.playprint.pl allows the following alternative payment methods:

Settlement of transactions by credit card and e-transfer is carried out via Dotpay.pl

In the case of payment in advance by bank transfer to the account of shop.playprint.pl, the Sales Agreement shall be effective subject to the purchase being paid for by the Customer within 7 days of confirmation of the order by the Customer. The Customer’s failure to effect payment within this time will result in the Sales Agreement being dissolved without the parties being required to make any additional statements, unless shop.playprint.pl and the Customer decide otherwise.

The length of time to complete the order, including the time to prepare and expedite the product is 2 working days* after payment is registered on the account. Shop.playprint.pl is required to provide the product to the Customer.

As standard practice, shop.playprint.pl sends a VAT invoice for the order by email.

Changes in the shop’s range of products and prices shall not be effected on a Sales Agreement which is concluded before such changes come into place. Shop.playprint.pl may organise promotional activities in which it allots a limited number of products for sale.

The product prices listed at shop.playprint.pl are gross prices.

 

COMPLAINTS

The Customer may file a complaint if the services provided for in these Terms and Conditions are not implemented by shop.playprint.pl or are implemented in a manner not in accordance with the Terms and Conditions, by sending an email to the address shop@playprint.pl.

A customer complaint on the grounds of the product not according with the Sales Agreement can be filed to shop.playprint.pl by email at the address shop@playprint.pl and should include at least:

  • customer details allowing identification and contact to be made;
  • the complaint relating to the product covered by the Sales Agreement;
  • the method the Customer wishes the alleged infringement to be redressed by (replacement of the product for one free of defects, withdrawal from the Sales Agreement [except if the defect is very small]).

 

Shop.playprint.pl replies to complaints at the email address provided by the Customer during registration within no more than 14 days of receipt of the complaint. If the information provided in the complaint is incomplete or insufficient for the complaint to be considered, shop.playprint.pl will reply to the Customer to request the necessary information within 14 days.

The Customer, as a consumer, has the right to withdraw from the Sales Agreement within 14 days of the date the goods were expedited in accordance with the principles set out in the law of 30 May 2014 regarding consumer rights.

The right of withdrawal is exercised by submitting an appropriate written statement. In order to comply with the time limit, the statement must be sent before the time limit expires. Product returns should be made promptly, not later than 14 days from the day on which the statement of withdrawal from the Sales Agreement is submitted. In order to comply with the time limit, the product must be sent before the time limit expires.

The Shop will refund the amount paid by the Customer promptly, not later than 14 days from the day on which the statement of withdrawal from the Sales Agreement is received. The cost of delivery and return shall be borne by the Customer and is not subject to refund.

 

PERSONAL DETAILS

The administrator of the Customer’s personal data is shop.playprint.pl, which shall process the personal data in accordance with the relevant laws.

Shop.playprint.pl processes personal customer data in respect to the laws and obligations deriving from agreements concluded in accordance with the provisions of these Terms and Conditions, including for the purpose of executing and settling those agreements, and otherwise only upon obtaining appropriate consents.

The Customer has the right to access content related to the Customer’s personal data and the right to correct them.

 

FINAL PROVISIONS

Shop@playprint.pl reserves the right to change the provisions of the Terms and Conditions.

Shop.playprint.pl shall inform the Customer of changes to the Terms and Conditions by providing relevant information on the Shop’s website. This information will indicate which provisions in the Terms and Conditions have been changed and what those changes are. That information will be supplemented by a complete and updated copy of the Terms and Conditions. Changes to Terms and Conditions enter into effect 14 days after making the information available to Customers. The Terms and Conditions which apply to Sales Agreements entered into before that date shall be those which were in effect on the date on which the Sales Agreement was entered into.

In the event of changes to the Terms and Conditions by shop.playprint.pl, the Customer may withdraw from the Agreement with immediate effect within 14 days of receiving information about the changes to the Terms and Conditions.

The law applicable to Agreements and Sales Agreements entered into based on the Terms and Conditions is the Polish Law.

*Except for all messages placed on the shop.playprint.pl website (including days off and holidays). Orders placed after 12:00 are expedited the next working day.
